Terhal Al modn for land transportation establishment is an individual enterprise registered with the Commercial Registration No. 4030316197, which is based in Jeddah, Saudi Arabia, and provides taxi drivers' activities to provide passenger services between cities by offering passenger and captain trips through its electronic platform called Rehla.

Definitions

All terms and conditions set out in these Terms and Conditions will have the meaning assigned hereunder:

‘We’ or ”us” acts as an expression of the entity of the urban transport establishment of land transport which means the application of Rehla, and is committed to protecting and respecting privacy.

Account - refers to the user account on the mobile application "Rehla" which allows the application to be used by the user,

Application - refers to the mobile application "Rehla" and will provide any updates from time to time.

Registration data - may include the name, phone number, e-mail, age and other information that the application may request from time to time, provided by users at the time of registration on the mobile application or otherwise.

Balance - means the value we hold in your wallet on our application, which you can directly use to pay the amount due for booking through the available booking channels, which may be changed from time to time.

Traveler - means any person who makes a reservation through the application on any vehicle displays its trips.

Intellectual property rights

Terms of Service

The application is operated by Terhal Al Modn establishment for Land Transportation and its subsidiaries, and the licensees by the establishment. User accounts

You must be at least 18 years of age to have an account and not more than 65 years of age. User requirements and behavior

Users must be at least 18 years of age and should be used by legally qualified individuals who are able to comply with binding contracts under applicable law in Saudi Arabia and neighboring countries. You may not allow third parties to use your account, and you may not allow persons less than 18 years of age to receive transportation services from your home unless they are accompanied by adults. You may not assign or transfer your account to any other person or entity. You agree to comply with all applicable laws when using Rehla app , and you are entitled to use Rehla app for legal purposes. Your use of Rehla app may not cause harm, inconvenience, harassment, or damage to property, be it in any passenger, vehicle’s owner, third party or others. If you choose a password that allows you to access certain parts of our platforms, you are responsible for maintaining on the secret of this password. Registration and use of the application

The use of this application requires registration of owners vehicles (Captains) and registration of vehicles and passengers who have the basic requirements to subscribe to the service in accordance with the requirements of the Ministry of Transport, which requires to be linked to the technical system adopted by the Public Transport Authority (Wasl Platform) according to the regulation on acceptance of registration so that users can deal with Rehla requirements

Prices, fees, payments and taxes

As Rehla user, you agree to pay any amounts payable by you if available for use of the Services provided to you by the Application. So that in the absence of sufficient balance the wallet will be negative to the maximum amount agreed upon, this may be modified at any moment without notice. For example, in the case of payment in cash from the passenger to the captain, the amount will be deducted from the captain's wallet (service charges and VAT charges). The fees paid are final and non-refundable unless otherwise specified by Rehla. All charges for the use of Rehla are due immediately, and payment will be facilitated through the payment methods available in your account (Wallet). As per the agreement between you and Rehla platform, Rehla reserves the right to charge, cancel, modify or otherwise, at any time at the sole discretion of the Rehla application. Fees may also be changed or revised at any time without your consent. In addition, you should acknowledge and agree that Rehla application charges in some geographical areas may increase significantly during peak demand times. Rehla will endeavor to inform you of the costs and charges of Rehla application that may apply, provided that you are responsible for the expenses incurred under your account, regardless of your knowledge of such charges or fees, as appropriate, or value.

Booking Terms

When the traveler has any reservation, he agrees and the person acting on their behalf that he has read these booking terms, agrees to be bound by them and has the authority to do so, and agrees to use our information in accordance with our Privacy Policy. All travelers must be fully aware of and understand the conditions during the booking process, as well as comply with all information provided. Booking is subject to the terms and conditions listed below and under the responsibility of the traveler. The booking process will not be successful if the payment is not paid in full through the wallet unless you choose to pay in cash. Cancellation and refund policy

In case of canceling the reservation after the payment of the fees in Rehla application by the driver or passenger after confirmation of the reservation is subject to the following conditions:

In case of canceling the trip or delaying the captain from attending

  • The passenger will recover the full amount paid when the driver cancels a trip or does not reach the meeting point after more than 15 minutes of the agreed time, with the need to communicate with him to prove that he has not responded to the call. The reservation amount is deducted from the captain's wallet and added to the traveler's wallet with the rest of the fees in full.
  • The passenger will refund the full amount paid in case the vehicle is disrupted during the trip from the captain or through deducting from the captain wallet and deposit it in the traveler's wallet.

In case of cancellation of the trip or the traveler has delayed from attending

  • If the passenger cancels the reservation 12 hours prior to the departure date as stated in the trip declaration, the passenger is entitled to a full refund of the cost seat. Service fees are maintained by the application and the driver receives no compensation.
  • If the passenger cancels the trip within 12 hours of the trip departure date as stated in the trip declaration, the passenger will bear half the cost of the seat and the rest will be transferred to the captain’s wallet. The service charge will be maintained by the application. In case of cash payment the captain’s will receive no compensation because he agrees to be paid in cash.
  • If the passenger cancels the trip prior to the departure date as stated in the trip declaration by three hours, or if he does not arrive at the meeting place 15 minutes before the agreed time, no amount is returned to the passenger. The captain is entitled to the full price of the seat. If the payment is in cash, the driver will not compensate for anything.
  • In these cases, the seat (s) canceled by the passenger will be provided when the booking is canceled to allow other passengers to book the trip, knowing that all users are subject to these conditions.
  • In some cases, the balance of the captain's or traveler's wallet is negative due to the non-payment of the dues on the previous trip that was paid in cash or because of the cancellation or modification of the reservation, while the method of payment you chose is cash payment. Therefore, he must settle the negative account by charge the balance of the wallet before the negative account exceeds SR 100. The account is presented for suspension from use.

If we cancel (Rehla application) your reservation

  • We may cancel your reservation at any time with immediate effect by sending a message, email or call if you have not paid all the required payments on your reservation in full and on time, or in case you otherwise violate one of the essential conditions of these booking terms. This is in addition to any other legal rights and damages that we may receive as a result of your breach of contract.
  • In exceptional circumstances, we may be forced to cancel your reservation due to "force majeure" conditions.

Repair or cleaning expenses

Rehla application or the passenger does not bear the costs of repair or cleaning as a result of the vehicle's exposure to dust, dirt or damage, with the need to be clean and in good condition so as not to affect the assessment of the vehicle and the captain.

Prohibited Activities

In addition to your use of the Platform and your participation in the Services, you agree to avoid doing certain prohibitions and, if so, you are solely responsible for complying with all laws, regulations, and orders. Your account may be subject to suspension,

  • 1. Impersonating any other person or entity as a passenger or captain.
  • 2. Transfer or sell your user account, password and / or identification to any third party.

  • 8. Abuse or transfer of drugs or alcoholic substances and any kind of prohibited species according to the laws of the Kingdom.
  • 9. Use of Rehla application in any way that infringes intellectual property rights, copyrights, patents, trademarks, trade secrets, other proprietary rights, copyrights, or the right to privacy or publicity.
  • 10. Publish, send an e-mail or the like to send any malicious code or other files or programs designed to block, damage, destroy or restrict the functionality of any computer program, device, communication equipment, theft or confiscated system, data or personal information.
  • 11. Forging key titles or otherwise manipulating the identifiers in order to hide the origin of any information sent across the platform.
  • 12. Modify, adapt, translate, reverse engineer, decode, dump or separate any part of a flight platform or any software used on or relating to the platform.
  • 13. Lease, lend, sell, re-distribute, obtain a normal license or sub-license to a flight platform, or access any part thereof.
  • 14. Use of any robot, search / retrieval facility, device or other manual or automated process to retrieve, index, delete, extract, or otherwise reproduce, circumvent or circumvent the content of the navigation or presentation of the flight platform or its contents

Payment method

This application is characterized by low price because the main objective is not to make money but to search for someone who accompanies the driver on the road. In this application the most common payment methods are used that are commensurate with the culture of Saudi and Gulf society in terms of safety and credibility. The accounting operations in the application are primarily focused on deducting from the wallet to manage the financial affairs of the traveler or captain, the balance of the wallet reflects the value of the cash available to make reservations and travel. There is a record of transactions to keep the parties all their transactions. The amount is deducted from the traveler's wallet after the reservation has been completed. Disabilities and medical issues

If you or any member of your group is suffering from a medical issue or disability that may affect your trip, please tell the captain when making your booking in the "Talk about yourself" box. The captain is entitled to accept the reservation or a refusal and bear the consequences of admission when he knows these details.

Disclaimer

Rehla platform is provided as it is currently available. Disclaimer all representations and warranties, express, implied or legal, which are not expressly set out in this Agreement, including implied warranties of merchantability, merit for a particular purpose and non-infringement. In addition, Rehla Platform makes no warranty, guarantee, quality, merit, other services through the use of Rehla application, or that the service is not interrupted on Rehla application or without errors.

Rehla application and its affiliates do not guarantee the quality, suitability, safety or capability of the driver. You should agree that all risks arising from your use of Rehla application and Services, and any service required in connection therewith, remain solely at your own risk, to the maximum extent permitted by applicable law, and the final choice is yours after returning to driver and passenger reviews for greater reliability.

Rehla application and its affiliates are not responsible for the behavior of any user, driver or other third party, whether online or non-use. We do not have to provide personal baggage insurance, including loss of personal luggage as a result of theft, hijacking or forgetting it in the vesicle. The owner of the vehicle is solely responsible for compensating all damages that may be caused to others during the service of the trip. The location data provided by the platform is for the purposes of the primary site only and is not relied upon in cases where accurate site information is required or where inaccurate or incomplete site data may result in death, personal injury, property, or environmental damage. Rehla application nor its affiliates nor any of its content providers do not guarantee the accuracy, completeness, reliability, or timeliness of the location data you provide or display on Rehla application. Any of your information, including professional data, may be uploaded or posted on Rehla application available to Rehla, partners, and drivers.

Limitation of Liability

Rehla application, affiliates and partners shall not be liable for any indirect, incidental, special, emergency, punitive or consequential damages, including lost profits, lost data, personal injury, damage to property, use of, or in connection with, Arising out of such use otherwise, even if Rehla application has been notified of the possibility of such damages.   • 4. You may use Rehla application to request and schedule the Services with the Driver. You agree that Rehla application and its affiliates have no liability or obligation to you for any Service provided to you by the Driver, other than as expressly provided in this Agreement.
  • 5. The limitations and disclaimers in this clause do not limit liability or change your rights as a consumer, which cannot be excluded under applicable law.
  • 6. The driver registered on Wasl platform shall not be allowed to drive the same vehicle.

Compensation

Resolving the dispute Arbitration

General Provisions

You may not assign or transfer your rights under this Agreement in whole or in part without a consent letter written by Rehla application. You are also bound to agree that Rehla application may assign or transfer its rights and obligations under this Agreement in whole or in part to an affiliate or subsidiary or a party that acquires ownership of Rehla application, business or assets or a successor through consolidation. The contract between you and Rehla application will not create any joint venture, partnership, employment relationship or agency between you and Rehla application or any driver. In the event that any provision of this Agreement is deemed unlawful, invalid or unenforceable, in whole or in part, under any law, this provision or part of it shall not be deemed to be in accordance with the limits to which this provision or part thereof is not part of Without prejudice to the lawfulness, validity and enforceability of other provisions of this Convention.
